550 CITY CENTRE COMMERCIAL ZONE (C5)

Permitted Uses

550.01 The following uses and no others shall be permitted in the C5 zone:

Adult Entertainment Use, limited to:

(1) taking place in conjunction with a shopping centre use;

(2) customer access to and from the premises being restricted to an enclosed pedestrian mall; and

(3) film viewers placed in enclosed spaces not less than 28 m2 with at least one side of the enclosure remaining open and unobstructed for a distance of 2.0 m measured vertically from the floor, and at least two other sides open for a distance of at least 75.0 cm measured in the same way.

Adult Video Store, limited to:

(1) taking place in conjunction with a shopping centre use;

(2) customer access to and from the premises being restricted to an enclosed pedestrian mall; and

(3) film viewers placed in enclosed spaces not less than 28 m2 with at least one side of the enclosure remaining open and unobstructed for a distance of 2.0 m measured vertically from the floor, and at least two other sides open for a distance of at least 75.0 cm measured in the same way.

Conditions of Use

550.02 A residential use, other than lobbies or entrance areas, shall:

(1) not be located on the first storey;

(2) not be located on the same storey as another permitted use unless the residential use is separated by a firewall with no circulation shared with other permitted uses;

(3) only be permitted where each dwelling unit is provided with a private, indoor storage area having a minimum capacity of 3.0 m³ and no dimension less than 1.2 m; and

(4) only be permitted where all required residential off street parking is separate from commercial parking.

550.03 A second hand goods use or thrift store shall not be located within a 300 m radius of another second hand goods use or thrift store. (B/L 913-2000)

550.04 Storage shall take place entirely within a wholly enclosed building, except storage related to seasonal garden centres subject to the following regulations: (B/L 438-97)

(1) shall not exceed 3.0 m in height;

(2) shall be sited in accordance with the setbacks as specified for storeys not containing residential uses in Section 550.08;

(3) shall be limited to that part of the lot surfaced with asphalt or concrete;

(4) shall not include storage of material or goods likely to produce or give off dust or other particulate matter that may become wind-borne; and

(5) where fenced, shall be limited to decorative fencing, a landscape screen with a minimum width of 1.5 m or a combination thereof.

Density

550.05 The maximum floor space ratio shall be 1.25 provided that this may be increased to a maximum of 2.75 as follows:

(1) 0.05 times each 1% of the lot area constructed as a pedestrian landscaped area, not to exceed 0.5;

(2) 1.0 times the ratio of underground parking to required off street parking, not to exceed 1.0.

Lot Coverage

550.06 The maximum lot coverage shall be 95%.

Height of a Building or Structure

550.07 The maximum height of any building or structure shall be 15.0 m.

550.08 Buildings and structures shall be sited in accordance with the following minimum setbacks:

Setbacks Between Buildings

550.09 Where an exterior wall of a dwelling unit faces another wall or corner of the same building or of another building on the same lot, the buildings shall be sited to provide a continuous 90º horizontal arc, unencumbered by any buildings or structures on the same lot, of a radius not less than:

(1) 15.0 m from the centre of any window in a living room;

(2) 12.0 m from the centre of any window in a habitable room other than a living room or a kitchen; and

(3) 3.0 m from the centre of any other window except a kitchen window.

Building Width and Length

550.10 No storey of a building or structure that contains a residential use shall have any building face exceeding a width or length of 30.0 m without an architectural break in any one continuous vertical plane. For the purposes of this Section, an architectural break means a feature or features altering the appearance of a building face in either the horizontal or vertical direction, in at least one of the following ways:

(1) An outward extension of the building face by at least 1.2 m;

(2) Walls recessed at least 1.2 m or angled not less than 30o; or

(3) Balconies or walls stepped back at least 1.0 m in successive storeys.
